Terms and conditions of use of the purenature.ee website

1. GENERAL

1.1. The Terms and Conditions of Use (hereinafter the Terms and Conditions of Use) regulate the use of the website (hereinafter the Website) located at www.elusvali.ee and the terms and conditions of sale of the goods (hereinafter the Goods) offered through it. The visitor of the Website (hereinafter referred to as the Customer) agrees to the Terms of Use when using the Website and purchasing Goods.

1.2. The owner and administrator of the website is Teletalu OÜ (hereinafter referred to as Pure Nature), address Tulbi tee 20, Rae village, Harjumaa, commercial register code 114102997, e-mail info@elusvali.ee.

1.3. The Customer can purchase the Goods offered on the Website through the Website.

1.4. All natural and legal persons can become a client.

1.5. In order to purchase goods from the Website, the Customer must complete and confirm the registration form. The client guarantees that:

1.5.1. all the information provided and the declarations made are correct;

1.5.2. he/she is a natural person with full capacity or full rights and authority to purchase Goods on behalf of the Customer. The Customer’s and the Customer’s representative’s confirmations are presumed to be correct and the Supplier is not obliged to verify them.

1.6. The right to use and publish the information and materials on the website belongs to Pure Nature.

1.7. The website contains links to third party websites that are not owned by Pure Nature. By clicking on the linked materials, the Client leaves the Website and the use of the linked website may be subject to terms and conditions that do not apply to the use of the Website by the Client. Pure Nature has no control over the linked websites and is not responsible for their use or the accuracy of the information contained therein.

2. BUYING GOODS FROM A WEBSITE

Shopping cart and placing an order.

2.1. The customer’s shopping cart (hereinafter referred to as the “Shopping Cart”) is created at the moment the customer clicks on the “Add to Cart” button. Adding an item to the shopping cart does not commit the Customer to purchase.

2.2. The Customer can change the quantity of Goods in the Shopping Cart and, if necessary, remove them from the Shopping Cart.

2.3. Goods in the shopping basket are available to other Customers until the order is confirmed.

2.4. To place an order, the Customer clicks on the “Proceed to purchase” button. After the purchase has been completed, an order confirmation is automatically sent to the Customer’s e-mail address.

2.5. When placing the order, the Customer chooses the payment and transport method of the Goods. The accuracy of the contact details provided in the order is dependent on the smooth delivery of the products purchased by the Customer and sometimes also on possible additional costs.

Payment for the ordered Goods.

2.6. The Customer can pay for the Goods via bank links or on the basis of a prepayment invoice (which will be sent to the Customer’s e-mail address at the Customer’s request).

2.7. You can pay for goods on the website via the following Estonian banks: Swedbank, SEB Pank, Luminor, LHV, Coop Pank and Pocopay.

2.8. If the Client wishes to pay by advance invoice, he/she should contact Pure Nature by e-mail at erki.laansalu@gmail.com. For payment solutions, Pure Nature works with Montonio Finance UAB.

Mode, conditions and time of transport.

2.9. Goods will be shipped to Estonia, Latvia, Lithuania, Finland

2.10. The buyer has the following options for picking up the goods: Intella SmartPost parcel machine, Intella SmartPost courier, DPD parcel machine, Omniva parcel machine.

2.11. The shipping costs are borne by the buyer, and the corresponding price information is displayed with the shipping method.

2.12. Shipments within Estonia usually arrive at the destination specified by the buyer within 3-5 working days from the entry into force of the sales contract.

2.13. In exceptional cases, you have the right to have the goods delivered within 45 calendar days.

3.1. The price of the Goods offered on the Website is given in Euros, excluding transport costs (unless otherwise stated on the Website).

4. CUSTOMER RIGHTS AND OBLIGATIONS

4.1. The Client undertakes to use the Website only for the purposes set out in the Terms of Use. The Customer is prohibited from using the Website for illegal transactions and/or fraud.

4.2. The Customer undertakes to pay the price indicated in the offer for the Goods.

4.3. The Client guarantees that the data entered by the Client when using the Website and the Client’s contact details (name, telephone number, e-mail address, etc.) are true, complete and up-to-date.

4.4. The Client undertakes to keep the user ID and password provided for the use of the Website in such a way that they do not fall into the hands of third parties, unless the Client has authorised such third parties to represent him/herself in the use of the Website and the purchase of Goods.

4.5. The Client shall inform Pure Nature immediately of any data and circumstances that have changed in comparison with the data and circumstances provided by the Client when registering as a Client on the Website.

4.6. The Client undertakes to immediately inform Pure Nature of the loss of the username and/or password provided for the use of the Website or of its disclosure to third parties.

 

5. LIFELONG RIGHTS AND OBLIGATIONS

5.1. Pure Nature may at any time, at its sole discretion, modify, supplement, replace or delete the Terms of Use and the price of the Goods offered on the Website, the conditions of sale and other information.

5.2. Amendments and supplements to the Terms of Use, the price of the Goods and other information will take effect from the moment the amendments are made on the Website. If the Customer has submitted an order before the change takes effect, the Customer will be subject to the terms and conditions in force at the time the order was submitted, unless otherwise provided by law or the Terms of Use.

5.3. Pure Nature has the right to restrict or revoke the Client’s right to use the Website, including closing his/her user account and not allowing him/her to register as a Client again, if the Client violates the Terms of Use or the obligations arising from them, if he/she has provided false or misleading information or otherwise behaves in a malicious manner.

 

6. CANCELLATION OF THE ORDER, RETURN OF GOODS AND REFUND OF MONEY

6.1. If the Goods are not suitable or do not meet the Customer’s expectations, the Customer has the right to return them to the Seller within 15 days of receipt of the Goods. Within the same time limit, the Customer has the right to exchange the unsuitable Goods for equivalent Goods, provided that the unsuitable Goods are unopened and in their original packaging.

6.2. In case of a request for return or exchange of the goods, the Customer must send a request with his/her details and bank account number to Pure Nature by e-mail to erki.laansalu@gmail.com.

6.3. In the event of return or exchange of the Goods, the Customer shall return the Goods to the Company without undue delay, but not later than 15 days after the date of the request, unless otherwise agreed between the Company and the Customer. Returned Goods must be unused and in their original packaging.

6.4. Pure Nature shall return the money for the returned Goods to the Customer’s bank account together with the amount spent for the transport as soon as possible, but not later than within 14 days from the receipt of the Goods by Pure Nature. The direct costs of returning the Goods shall be borne by the Customer, unless otherwise agreed between Pure Nature and the Customer.

 

7. PRINCIPLES OF PROCESSING CUSTOMER PERSONAL DATA

7.1. Pure Nature processes the Customer’s personal data to fulfil purchase orders placed by the Customer.

7.2. In addition, Pure Nature processes the Client’s personal data for the purpose of sending commercial communications, promotional materials and information about the Goods and activities offered by Pure Nature, if the Client has expressed its wish to do so.

7.3. Pure Nature collects and stores the Client’s personal data in electronic form, and extracts them in another form if necessary. Pure Nature has the right to store the Client’s personal data for the period necessary to fulfil the obligations arising from the offers published on the Website.

7.4. Pure Nature has the right to forward the Customer’s personal data to third parties selected by Pure Nature and related to the performance of the purchase transaction (e.g. courier service provider, postal service).

7.5. The Client has the right to know what data about him/her is contained in the Pure Nature database by submitting an enquiry to the Pure Nature e-mail address provided on the Website. The customer has the right to modify and correct his/her personal data.

7.6. The Customer has the right to withdraw the consent to the processing of personal data by Pure Nature at any time, to request the cessation of the processing of personal data and the deletion or blocking of the collected personal data, as well as the closure of the user account. For this purpose, the Client shall submit a request to the e-mail address of Pure Nature indicated on the Website. Withdrawal of consent does not have retroactive effect.

8. Processing of personal data

8.1. The Website will use the Customer’s personal data for the performance of the sales contract.

9. NON-CONFORMITY OF GOODS WITH THE CONDITIONS OF SALE AND LIABILITY

9.1. In the event of non-conformity of the Goods offered for sale on the Website with the terms and conditions of sale, the Customer must submit a complaint to Pure Nature by e-mail to erki.laansalu@gmail.com, stating the Customer’s name, contact telephone number, order number and a precise description of the non-conformity or defect of the Goods.

9.2. The Customer must lodge a claim within 15 days of receipt of the Goods. Pure Nature shall review the complaints and respond to the Customer as soon as possible, but not later than 15 days from the receipt of the complaint.

9.3. Pure Nature shall be liable to the Customer for any damage caused by Pure Nature’s breach of the Terms of Use in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.

9.4. The Customer shall be liable to Pure Nature for any damage caused by the Customer’s breach of the Terms of Use in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.

9.5. Pure Nature shall not be liable for damage to the Goods caused by the Customer or due to the Customer’s negligence, for defects caused by improper use of the Goods or for damage caused during transport of the Goods.

9.6. Neither party shall be liable to the other party and its conduct shall not be deemed a breach of the Terms of Use by reason of its delay in performing or failure to perform any of its obligations if the cause of such delay or failure was beyond its reasonable control (force majeure).

 

10. OTHER CONDITIONS

10.1. All notifications and information from the Living Environment to the Client will be sent electronically via the contact details provided by the Client when registering the account. All notifications and information from the Client to the Living World will be sent via the contact details published on the Website.

10.2. If any provision of the Terms of Use is found to be inconsistent with the provisions of the law, this shall not invalidate any other provision of the Terms of Use. In such a case, the invalid provision shall be replaced by the law.

10.3. The Terms and Conditions of Use are valid from the moment of acceptance of the Terms and Conditions of Use on the Website by the Client and are valid for the duration of the legal relationship between the Client and the Provider governed by the Terms and Conditions of Use.

10.4. The legal relations between the Client and Pure Nature arising from the use of the Website shall be governed by the law in force in the Republic of Estonia.

10.5. Disputes arising from the use of the Website shall be resolved by negotiation between the Client and Pure Nature. If no agreement is reached, the dispute will be settled by the Harju County Court.

10.6. If disputes cannot be resolved by negotiation, the Consumer Customer may also turn to the Consumer Protection Board (Pronksi 12, Tallinn 10117, www.tarbijakaitseamet.ee) for advice and clarification or refer the dispute to the Consumer Disputes Committee of the Consumer Protection Board. Complaints can also be submitted to the Consumer Disputes Committee via the online dispute resolution platform at http://ec.europa.eu/odr, and the rules of procedure can be found at www.tarbijakaitseamet.ee.
